Terms of Service

These Terms of Service ("Terms") govern your access to and use of Staff Hub ("the Service"), an employee training and engagement platform provided by Staff Hub ("we", "us", or "our"). The Service is available as a Shopify application and as a standalone web platform at app.staffhubapp.com. By installing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By installing Staff Hub from the Shopify App Store, creating an account on our web platform, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not install or use the Service.

2. Description of Service

Staff Hub is an employee training and engagement platform available as a Shopify embedded app and as a standalone web application. Staff Hub provides employee training and engagement tools including, but not limited to: training modules, learning paths, quizzes, announcements, tips, team messaging, channels, polls, scheduling, time-off management, performance reviews, onboarding workflows, staff directory, org chart, skills matrix, badges, leaderboard, goals, document library, activity feed, audit logs, analytics dashboard, and billing management.

3. Account and Registration

To use the Service, you must either have an active Shopify store or create an organization account through our web platform at app.staffhubapp.com. Additionally, you must:

  • Install the app through the official Shopify App Store, or register for an account on our web platform
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account

4. Subscription and Billing

4.1 Pricing Plans

We offer multiple subscription tiers (Basic, Pro, Enterprise) with different features and limits. All plans include a 14-day free trial. Current pricing is displayed on our website and the Shopify App Store listing.

4.2 Billing

Shopify users: Subscription fees are billed through Shopify's billing system. By subscribing to a paid plan, you authorize Shopify to charge the applicable fees to your payment method.

Web platform users: Subscription fees are billed through Stripe, our secure payment processor. By subscribing to a paid plan, you authorize Stripe to charge the applicable fees to your payment method.

4.3 Changes to Pricing

We may modify pricing with 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.

4.4 Refunds

For Shopify users, refund requests are handled according to Shopify's refund policies. For web platform users, refund requests are handled in accordance with our refund policy. Contact us within 14 days of purchase if you're unsatisfied with the Service.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service's operation
  • Impersonate others or provide false information
  • Use the Service to harass, abuse, or harm others
  • Violate any applicable laws or regulations
  • Resell or redistribute the Service without authorization

6. Content

6.1 Your Content

You retain ownership of content you create using the Service (training materials, announcements, etc.). By uploading content, you grant us a license to store, display, and process it as necessary to provide the Service.

6.2 Content Responsibility

You are solely responsible for the content you upload. You represent that you have the necessary rights to use and share such content and that it does not violate any laws or third-party rights.

6.3 Content Removal

We reserve the right to remove content that violates these Terms or is otherwise objectionable, without prior notice.

7. Intellectual Property

The Service, including its design, features, and code, is owned by Staff Hub and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

8. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Staff Hub and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

12.1 By You

Shopify users: You may uninstall the app at any time through Shopify's admin panel. This will terminate your access to the Service.

Web platform users: You may cancel your subscription at any time through your account settings or by contacting support at [email protected]. This will terminate your access to the Service at the end of your current billing period.

12.2 By Us

We may suspend or terminate your access if you violate these Terms or for any other reason with notice when practical.

12.3 Effect of Termination

Upon termination, your right to use the Service ends immediately. We may delete your data within 30 days of termination.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance.

14. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Staff Hub.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Failure to enforce any provision does not waive our right to enforce it later.
  • Assignment: You may not assign these Terms without our consent. We may assign them freely.

15. Governing Law

These Terms are governed by the laws of the jurisdiction where Staff Hub operates, without regard to conflict of law principles.
